When you may be entitled to compensation

Under EU Regulation EC 261/2004, you may be entitled to compensation if your flight is:

  • delayed and you arrive at your final destination at least 3 hours late
  • cancelled
  • affected by denied boarding, for example because of overbooking
  • part of a single booking and a disruption causes you to miss a connecting flight and arrive at your final destination at least 3 hours late

EU passenger rights generally apply when:

  • your flight departs from an EU airport, regardless of the airline, or
  • your flight arrives in the EU from outside the EU and is operated by an EU-based airline

Whether compensation applies depends on the circumstances of the disruption.

How much compensation can you receive?

Depending on the flight distance and circumstances, compensation under EU passenger rights can generally be:

  • 250 EUR
  • 400 EUR
  • 600 EUR

The final amount depends on factors including the flight distance, delay at your final destination, and whether you were rerouted.

When compensation may not apply

Airlines generally do not have to pay compensation when a disruption was caused by extraordinary circumstances that could not have been avoided even if reasonable measures had been taken.

Examples may include:

  • severe weather
  • air traffic control restrictions
  • political instability
  • security risks
  • some strikes outside the airline, such as airport or air traffic control strikes

Strikes by the airline’s own staff are generally not considered extraordinary circumstances.

AirHelp checks the circumstances of your flight to determine whether it may qualify.

Baggage delays, damage, or loss are covered by different passenger-rights rules, including the Montreal Convention. They are not handled as EC 261 flight compensation claims through Flight Claim Assistant.

The time limit for making a flight compensation claim can also vary depending on the country and circumstances of the claim.
